1. Acceptance of Terms

By booking or using ECOFUNDRIVE's chauffeur services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users of our services, including individual passengers, corporate clients, and third-party bookers.

2. Service Description

ECOFUNDRIVE provides premium chauffeur services using Tesla Model S vehicles on the French Riviera. Our services include but are not limited to:

• Airport transfers to and from Nice Côte d'Azur Airport
• Point-to-point transfers between locations on the French Riviera
• Hourly chauffeur service with a minimum booking of four hours
• Event transportation for conferences, festivals, and special occasions
• Corporate transportation services

All services are subject to availability and must be booked in advance through WhatsApp communication at +33 6 16 55 28 11.

3. Booking and Confirmation

Bookings are made exclusively through WhatsApp communication. A booking is considered confirmed only when you receive written confirmation from ECOFUNDRIVE via WhatsApp, including the exact price, pickup time, and service details.

You are responsible for providing accurate information including pickup location, destination, date, time, number of passengers, and flight details where applicable. ECOFUNDRIVE is not liable for missed transfers resulting from incorrect information provided by the client.

For airport transfers, we track flight arrivals automatically. However, you must provide accurate flight information at the time of booking.

4. Pricing and Payment

ECOFUNDRIVE operates on a transparent pricing model with rates set at 20% above Uber Black pricing for equivalent routes. All prices quoted at the time of booking are final and include all applicable taxes, tolls, and fees unless otherwise specified.

For hourly services, the rate is 100€ per hour with a minimum booking of four hours (400€). Any time beyond the booked duration is charged at the hourly rate, rounded to the nearest half-hour.

Payment is typically collected at the conclusion of service. We accept credit cards, cash (Euros), and bank transfers for corporate accounts. No processing fees are charged regardless of payment method.

5. Cancellation and Refunds

Cancellations must be communicated via WhatsApp. The following cancellation terms apply:

• 24 hours or more before scheduled pickup: Full refund, no cancellation fee
• 12-24 hours before scheduled pickup: 50% of the total booking fee charged
• Less than 12 hours before scheduled pickup: 100% of the total booking fee charged
• No-show: 100% of the total booking fee charged

For flight delays or circumstances beyond your control, we may waive cancellation fees at our discretion. Please contact us as soon as possible if your plans change.

6. User Responsibilities

Users of ECOFUNDRIVE services agree to:

• Arrive at the designated pickup location at the scheduled time
• Behave respectfully toward the chauffeur and maintain appropriate conduct
• Not consume alcohol or illegal substances in the vehicle
• Not smoke or vape in the vehicle
• Ensure that luggage and belongings fit within the vehicle's capacity
• Supervise children and ensure appropriate child seats are requested if needed
• Comply with all applicable laws and regulations during the transfer

ECOFUNDRIVE reserves the right to refuse service or terminate a transfer in progress if a passenger violates these responsibilities or behaves in a manner that threatens the safety or comfort of the chauffeur or other passengers.

7. Limitation of Liability

ECOFUNDRIVE maintains comprehensive insurance coverage for all vehicles and services. However, our liability is limited as follows:

We are not liable for delays caused by traffic conditions, road closures, weather conditions, or other circumstances beyond our reasonable control. While we make every effort to ensure punctual service, travel times are estimates and cannot be guaranteed.

ECOFUNDRIVE is not responsible for personal belongings left in vehicles. While we make reasonable efforts to return lost items, we cannot guarantee their recovery.

In no event shall ECOFUNDRIVE's liability exceed the amount paid for the specific service in question. We are not liable for indirect, consequential, or incidental damages including but not limited to missed flights, meetings, or events.

8. Vehicle Capacity and Luggage

Tesla Model S vehicles accommodate up to four passengers comfortably. The trunk capacity accommodates standard luggage for four passengers. If you have oversized luggage, sports equipment, or excessive bags, you must inform us at the time of booking.

ECOFUNDRIVE reserves the right to refuse excessive luggage that cannot be safely accommodated in the vehicle. No refund will be provided if service cannot proceed due to undisclosed luggage requirements.

9. Privacy and Data Protection

ECOFUNDRIVE collects and processes personal information in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Your personal information is used solely for the purpose of providing chauffeur services and will not be shared with third parties except as required by law.

10. Intellectual Property

All content on the ECOFUNDRIVE website, including text, graphics, logos, and images, is the property of ECOFUNDRIVE and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without explicit written permission.

11. Modifications to Terms

ECOFUNDRIVE reserves the right to modify these Terms of Service at any time. Changes become effective immediately upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the modified terms.

We encourage you to review these terms periodically. The "Last Updated" date at the top of this page indicates when these terms were last revised.

12. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of France. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Nice, France.

13. Dispute Resolution

In the event of any disagreement or dispute, we encourage clients to contact us directly via WhatsApp at +33 6 16 55 28 11 to resolve the matter amicably. Most concerns can be addressed through direct communication.

If a dispute cannot be resolved through direct communication, both parties agree to attempt mediation before pursuing legal action.

14. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
